Studies on the rulings of judiciary and governance in Islam still require deep and precise examination, through which one can identify the areas of deficiency and strength in this science. Fate has brought me together with some professors from law faculties in my country, and we had extensive discussions about the study of the history of law in Libya specifically and how it is taught in law schools, as well as the literature available in this field. The discussion concluded that the development of legal materials and the study of its history and legislation in Libya in general needs someone to unveil and highlight it for specialists in this area, as the life of society is in continuous development — in customs and traditions — which differ from generation to generation, and I have determined, based on my knowledge, that this period is about 25 years between one generation and another. For example, the courts in 1940 differ from those in 1970, and so on. This research addresses how judiciary and its rulings were in Islam and how the Prophet Muhammad (peace be upon him) and his companions, may Allah be pleased with them all, established its principles, despite the existence of many studies that have tackled this subject, which were mixed and encompassed many of its branches and issues. I attempted to extract some principles and foundations for this noble science, and how the application of God's limits among Muslims was without discrimination, as it is said, "everyone is under the law," thus ensuring justice, security, and safety in the lands of Islam, which is the foundation for the advancement of nations in all aspects of life.
